Premises Liability
In the law, a term that is often used is Premises Liability. Like many other legal terms, this isn’t one that is normally used in everyday language. But if you’re looking for information after being hurt on someone else's property, it’s a term that you will often come across.
What is a Premises Liability Case? When you visit another home or a retail store, you assume that your host or the business owner holds your safety in the highest regard. That’s because the owner is using the property to make money. He or she wants you to come to the property and spend your money there. Whether it’s a grocery store, movie theatre, or even someone else’s home, having you be there is good for business. As a society, we have all agreed that if someone is making money by inviting you to their property needs to make sure that it’s safe for you to be there.
Unfortunately, due to a variety of reasons, this is not always the case. Injuries that occur as a result of a property owner’s negligence are not your fault, and you should not be held responsible for another individual’s carelessness.
At Marcotte Law Firm, our lawyers have more than 150 years of combined experience helping individuals in Lowell and surrounding communities who have been the victim of negligence. We work with people who have been hurt in the following:
- Slip-trip-and-fall accidents
- Snow and ice accidents

- Accidents due to negligent security
- Construction site accidents
- Dangerous Floors and Surfaces
- Wet or slippery surfaces
- Partially torn up carpet
- Stairway Accidents
These accidents can have an array of impacts on an individual, including:
What Should I Do if I’m Injured on Someone’s Property? If you’re injured, call an ambulance. But if it’s possible, it’s always a good idea to let the store owner or manager know that you fell. A reputable business will fill out a report about what happened. It will get the names of witnesses, and it will preserve surveillance video of what occurred.
Evidence and written reports are often the most important components of premises liability cases. But not all businesses and managers are as diligent as they should be. If you can, you should take photos of where the accident took place and of your injuries.
Visit a medical professional as soon as possible and make sure you file any and all reports that are available to you and request a copy. Don’t rely on the store to give you the names and phone numbers of witnesses. Get them at the scene if it’s possible.
Even if you were not able to work quickly after your accident and accomplish these tasks, our attorneys will work diligently to help you obtain the best outcome possible for your case.
